Court strikes out RM218 mln suit against Umno

The High Court struck out Elegant Advisory Sdn Bhd’s RM218 million suit against Umno over alleged non-payment for items the company claimed to have supplied during a general election.

Judicial Commissioner Anantham Kasinater, who made the decision in chambers, said the application was without basis and did not follow the Contracts Act 1950.

During the course of submissions, counsel for the plaintiff conceded that there was no written contract. Counsel was unable to highlight the terms of any oral contract.

The plaintiff, when required to provide particulars of the oral agreement to prove privity of contract, was unable to do so. In his 10-page written judgment, Anantham also said that the plaintiff’s claim was frivolous and vexatious.

In its writ of summons, Elegant Advisory said it was engaged in the supply of election merchandise, transportation and publications and that it had supplied Umno with these items for the 11th GE in 2004.

The company claimed that it had sent Umno invoices for a sum of RM218,013,475 and that the party has failed to pay up.

Anantham also said that Section 71 of the act was not founded on contract but embodied the equitable principle of restitution and unjust enrichment.

In our words, the section is applicable to relationship resembling those created by contract but not those based on contract.

The plaintiff would appeal against the decision.

Where a person lawfully does anything for another person, or delivers anything to him, not intending to do so gratuitously, and such person enjoys the benefit thereof, the latter is bound to make compensation to the former in respect of, or to restore, the thing so done or delivered.

New English Word- “SEXTING”

In Houston, Texas, thousands of students are returning to school to discover a new rule: no ‘sexting’ – the distribution of nude or semi-nude photographs or videos by text message.

“They were reporting that it was an issue and may be becoming more of a problem,”.

A recent study by the National Campaign to Prevent Teen and Unplanned Pregnancy found 22 % of US teenager girls and 18% of teenager boys have sent messages or posted images or video online showing them nude or semi-nude.

“A student may be sending pictures to their boyfriend and they break up and he sends it to everybody,” said Graff.

Couple who gave house to son now homeless

SIN Chew Daily reported that an elderly couple in Singapore who gave up their duplex to their son ended up homeless after they were chased out of the house by the ungrateful offspring.
The couple now call the staircase of a school their home.
The man, who was named as Lim, was a manager before he retired. He had a son and a daughter who lived in Jurong, Singapore.
Relating his ordeal to a secretary of the school, Lim said he and his wife decided to give their duplex home to their son as a wedding gift about two years ago.
The couple thought that they could live in the house with their son. He, however, decided to sell the property for RM960,000 to buy another condominium. Lim and his wife were then sent off to live with the daughter.
After a year, the daughter decided that they were no longer welcome and banned them from touching her children.
The couple could not enter the house after their daughter changed the locks to the house.

I am not surprise with the headline. Nothing new and I come across similar stories whenever the issue of distribution of property, inherited fortune is mentioned. Some even drag their parents to court and face the wrath of court cases. I can understand the love parents are trying to show. If you ask me, I would only support my children till tertiary education & hoping they can land a good job and fence and able to look after themselves.

An epitome of lifelong learning

At 66, Gurcharam Kaur ( umh; I’m only 41 and maybe old enough to pursue a course) is now a proud degree holder after having had to put her dreams on hold to take care of her parents and help bring up three younger siblings. ( poor family background sometimes do help to improve oneself)

The former English teacher received her Bachelor’s Degree in Education ( Teaching English as a Second Language or TESL) at the 33rd UPM convocation ceremony. In June 2005, Gurcharam, who has 40 years of teaching experience under her belt, decided to further her studies at UPM.

Her decision followed encouragement from her siblings who became successful in their own right.

` I did not encounter any problems during my 4 years of long-distance learning at UPM….rather, I received excellent grades five times,” said Gurcharam who currently lives in Negri Sembilan.

For those out there, it’s a perfect example of lifelong learning. One should embrace CHANGE! Lifelong learning its an opportunity for the mass population to obtain quality tertiary education via open learning concept at affordable costs. It would also enlightened ones future.

For directors of company, its time to promote a lifelong learning culture in your organization. KNOWLEDGE IS POWER. It would certainty benefit the company in terms of creating a knowledgeable employees that would bring the company to greater heights and enhance its competitiveness in their relevant sector. Its an arduous task though but its definitely not an inane idea; maybe to others yes but the choice is your to determine your own future.

In USA- Debate as crisis spurs people to work for free

New York: With US unemployment at a 20-year high, some Americans are working for FREE while looking for jobs, but experts are split over whether it is a sign of dedication or desperation.( Malaysians are too busy to work for FREE!)

Dana Lin, 22, is one of the 14.7 million unemployed workers in the US. She lost her marketing job at a technology company near San Francisco in April and since then has been working for FREE for about five hours a week for Internet company Jobnob.com.
“Every company has thousands of people applying for each job, and I realized I needed more appeal.” ( epitome of a quality employee)

British Airways last month asked its British-based employees to volunteer for up to a month’s unpaid work.

Job opportunities are aplenty but locals are choosy about jobs, making the country dependent on foreign workers to fill vacancies.

According to Assistant Minister of Infrastructure Development and Communication Datuk Lee Kim Shin; “ Unemployment does not mean our country or industries cannot provide people with jobs. Our locals are making themselves unemployed because of their choosy altitude. ( Unh, or our education system to be blamed, churning out thousands and thousands of UNEMPLOYABLE Gradutes every year!)

Gamblers sues casino for lost fortune

SEOUL: A former South Korean company boss who says he gambled away 30 billion won ( US$23.5 million) in three years is suing a casino for allegedly fuelling his addiction.

The man identified only as Chung, 67, is appealing a court ruling last November which ordered the Kangwon Land casino to pay him 2.8 billion won in damages.

Chung says this is not enough since between 2003 and 2006 he lost 30 billion won at the casino – the country’s only one authorized to admit Koreans under strict gaming laws.

The former head of a leather products company claims the government-run casino turned a blind eye to him making bets above the legitimate limit.

Stressed at work? You’re not alone

FEELING stressed and overworked and burned out? You’re certainly not alone these days.

Layoffs and other workforce reductions have left so called survivors with increased workloads and other challenges, according to a new survey of more than 4400 workers by CareerBuilder.com.

Nearly half of the workers said they have taken on more responsibility because of a layoff, while 37% said they are handling the work of two people. The survey also found that 34% of workers are spending more time at the office, and 22% are working more weekends.

“Not only will this impact you personally but this is something that’s impacting productivity overall,” says Jennifer Grasz, a spokewoman at CareerBuilder. “When you have workers who are highly stressed and burned out, they’re not going to be performing at the same level.”

CareerBuilder offers some tips on how to keep your stress level in check.

Ø Take some time to recharge

Another CareerBuilder survey found that 35% of 4400 workers survey said they haven’t gone on or aren’t planning to take a vacation this year. Nearly one in five workers said they’re either afraid of losing their jobs if they do or feel guilty about being away.

Grasz says, “Workers need to recharge. It’s counterproductive not to take the time off,” she says.

Ø Prioritise your tasks

Speak to your superior to get feedback on what you should tackle first.
“So that it doesn’t feel like 10 things have to be done in one day,” Grasz says.

Ø Cut the e-leash

That means when you’re on vacation, don’t check your e-mail or voicemail.

“ Says Grasz: “ You need the time to get away from the office, recharge and bring the stress levels down so that when you come back, you could tackle projects more effectively.”

Ø Try to ignore rumours.

Getting caught up with gossip can also distract you from work

If your concerns are serious enough, talk to your supervisor or human resources.

Otherwise, “it’s more important to stay focused on being effective in the things you’re working on,” Grasz said.

She added.” It’s also going to serve you within the organization if you’re known to be
someone who’s working hard.”

When someone says, “ I’ve been working really hard,” or “I’m really stressed out,” we are taught to admire, even emulate their behaviour.

Maybe when one’s schedule is getting out of hand, it’s time to slow down and reevaluate what’s important and urgent rather then power through everything on the list.

Stress management is one option but I believe stress consultants are stressed out too!

And of course we are not alone and would never be alone as what I myself experienced in my job.

Thailand wants to supply S'wak with quality workers

Thailand is looking forward to establishing further bilateral rapport with the state gov't to supply S'wak with skilled and quality workers.

Thai Minister of LAbour Phaithoon Kaeothong said as many as 4,000 Thai workers had been working in S'wak and Sabah, showing that the country was capable of offering what the state required.

" Many Thai labourers have worked in S'wak and Sabah while Global Upline Group has recruited many from Thailand as technical workers," he told a press conference at Four Points by Sheraton Kuching yesterday.

Global Upline Sdn Bhd has also completed Four Points by Sheraton Kuching hotel ahead of time and the majority of workers involved in these development project were Thais. Other projects are KIA and Sabah International Airport & hospitals in East M'sia.

He thus believed that Thai workers, in terms of technical requirment, quality and capability, would be able to meet tha labour demand in the state.

From the prognosis above, do Malaysian construction industry lacking workers? In my opinion, its a definite NO! Then what's the problem? Are our local workers lack quality, discipline, uneducated, not capable, less committed, no desire to succeed, refuse to working long hours, irresponsible, succumb to pressure, dishonest, taking jobs opportunity for granted or becoming indolent? Is the employers uncaring? Surely these are the important questions b'cos they have a direct bearing on the success of a project.

I'm sounding exasperated b'cos the situation is unlikely to improve in the near future. Importing workers from abroad is not only timely but a neccessity in constrcution industry.

We may now all ponder why Global Upline project are always ahead of schedule.

An Arab & A Jew...

An Arab needed a heart transplant, but prior to the surgery the doctors needed to store his blood type in case the need arises.

Because the gentleman had a rare type of blood, it couldn't be found locally. So the call went out to a number of countries. Finally, a Jew was located who had the same blood type and who was willing to donate his blood to the Arab.

After the surgery, the Arab sent the Jew a thank-you card for giving his blood along with an expensive diamond and a new Rolls Royce car as a token of his appreciation.

Unfortunately, the Arab had to go through a corrective surgery once again.. His doctors called the Jew who was more than happy to donate his blood again. After the second surgery, the Arab sent the Jew a Thank You card and a box of Almond Roca sweets.

The Jew was shocked to see that the Arab this time did not acknowledge the Jew's kind gesture in the same way as he had done the first time. So he phoned the Arab and asked him why he had expressed his appreciation in not a very generous manner.

The Arab replied: "Ya Habibi !!, (Dear Friend) you have to remember, I have Jewish blood now!"

Contractors told to furnish safety policy statement

The National Institute of Occupational Safety and Health ( NIOSH) wants contractors bidding for contracts to furnish a safety policy statement.

Besides this statement, which would be a system of hazard identification, risk assessment and risk control ( HIRARC), they should also provide information regarding the experience and safety training given to their employees, said NIOSH Tan Sri Lee Lam Thye.

Developers had a responsibility to choose competent and safety conscious contractors, and the acceptance of low bidders should not be at the expense of safety and health. He said in a statement.

“ Those who create the risks and hazards are in a better position to manage them. Contractors or sub-contractors should be responsible and be fully committed to quality work, safety standards and practices,” he said.

Lee also said that everyone involved in the construction industry should realize the dire consequences of flouting safety guidelines and cutting corners, poor design, shoddy workmanship and inadequate supervision.

NIOSH called on all industries, particularly the construction industry, to be always sensitive to the demands for safety at the workplace and work towards an accident-free or zero accident target, he said.

The advice by NIOSH comes in the wake of public apprehension over the safety of buildings following the collapse of structures, including a section of the roof of a stadium in Trengganu and a building under demolition in Petaling Jaya, Selangor.-Bernama

A Trip to Tanjung Manis,Sarawak

On 9-10 June 2009, we made a trip to Tanjung Manis to visit a project site as a pre-qualifier with an established Class A Contractor based in KL. The briefing was scheduled on 10 June 2009 @ 8.30am.

I started my journey from Kem Oya project site enroute to Sibu airport to fetch our 2 partners; Mr. Ng and Mr. Tommy Tay. After that I decided to stop by a food centre at SingKwong shopping Mall to quench our thirst and sharing a few buns before continuing our journey.

At about 3.00pm, we headed to Sarikei, which is an hour drive. It was a fun ride because we take advantage of the commute and I find myself talking to a Director of a fairly large corporation which was sharing his experience with me for the past 25 years.

We reached Sarikei at about 5:30pm and stated to enquire the best hotel in town where we can put up a night. At last we found one Oriental Hotel at a rate of RM55.00 for a twin bedroom. ( no complimentary breakfast, luggage trolley, door man ).That’s Ok I thought; a long as its clean. Quite a nice hotel and its 5 mins drive to the jetty.

At 7.00pm, we sneaked out to feel our stomach. Again we enquired the best restaurant in town. We took quite sometime to find one. At last we stopped at an air-conditioned restaurant which coincidently is celebrating its 1st Aniversary of operation. We came to know the good news when we’re served 4 red colored eggs. Hi, we didn’t order any eggs, I wonder. `It’s free, replied the waiter because today is our 1st Aniversary, she explained.

Generally the food is ok only lah! Of course Kuching restaurant better. What to do! We ordered pork leg with black soy, vegetables, steamed fish and of course a few bottles of beer to relieve our backache! Eh, since when beer can relieve backache. Aiyah, it’s just an excuse.

We have a good time and sharing our experiences especially in this tough & challenging construction industry. Mr. Ng career started with a humble beginning; from a subcontractor to director. We finished dinner at about 9:30pm and headed to hotel for an early rest.

Morning called at 6:15am. Breakfast at 6:45am. Kolo mee for breakfast. Again taste ok only lah. The express boat departed at 7:30am and reached Tanjung Manis @8:40 due to a few stops.

The client fetched us at the jetty and straightaway proceeded to the site briefing in one van carrying 20 of us. The briefing lasted only 30 minutes as the consultant were in a hurry to return to Sibu for shopping! Sigh….What to shop in Sibu? Why don’t they ask me? If they did, my answer would be KL better!

In fact we had not seen enough of the site & its surrounding. We decided to `rent’ the same van to revisit the site. Sourcing for materials; ready-mixed cement, crusher run, sand, other building materials is our main priority. Mr. Ng gave RM100 to the driver for his `overtime’ job.

On the site itself, it’s a fairly flat ground and accessible with infra works completed. We completed our rounds at 11:00am and took a returned express boat to Sarikei. We reached Sibu at 1:30pm and rushed to Sibu airport to collect there air tickets to KL departing 8;20pm and retimed to 9:10pm.

Overall, it’s an enjoyable & memorable trip from land to sea transport for me. As for Mr. Ng and Mr. Tommy, it’s land-sea-air mode of transport.

My Birthday

Today 31.05 is my 41st birthday. Time flies. Again it's another year older and am a wiser lot now. As usual, my kids wish me `Happy Birthday' and my ever loving and supportive wife, too but by e-mail electronic card. She is technology advance!.

As a tradition, my breakfast comes with 2 ( Only 2, and i wonder why not more ??) red boiled eggs and dumpling too. In fact, dumpling day it's my `Chinese calendar' birthday. I'm yet to find out the date which falls under `Indian calendar'.

well, i sincerely hope my work, career will achieving great success and my wish is to complete my current project by end of November and of course stay healthly!

The young leaders of Sarawak United People’s Party should try to improve their intelligent quotient (IQ) as well as their emotional quotient (EQ) if they aim to become leaders of the future.

This advice was made by Dato’ Sri Wong Soon Koh in his address at the installation ceremony of SUPP Sibu BranchYoung Women’s Wing last Sunday night.

Wong said that being a leader, one has to have such qualities not only to cope with the demands as a leader, but also to command the respect of the followers.

“ In any organization, where people are involved, change in leadership is a natural progression.

“ This is what we can see tonight, where new leaders of tomorrow are being groomed. As such, you need to seek to improve your IQ and EQ to cope with the demands of being leaders of tomorrow,” he pointed out

In his fascinating new book Outliers: The Story of Success, Malcolm Gladwell makes a strong case that people owe their success to a lot more than IQ. He reviews data and offers convincing cases to show that above an IQ in the neighborhood of 110-115, IQ fails as a predictor of success in a career. In other words, you need to be smart enough to handle the cognitive complexity of the information you need for a given role or job, be it engineering, law, medicine, or business. That’s the IQ around 115. But after reaching that threshold of “smart enough,” your intellect makes little difference.

That explains why, when Harvard’s Howard Gardner reviewed longitudinal data that follows people from their early years into their career, he concluded that IQ alone predicts just 6 to 10 percent of career success. That leaves lots of room for other factors, like luck and circumstance. Gladwell makes the case for these very factors, arguing that one’s cultural and family background offer habits and outlooks that, given fortunate historical circumstances, can make some people highly successful

Emotional Intelligence (EQ) vs. Intellectual Intelligence (IQ)

Most of us have learned not to trust our emotions. We've been told emotions distort the more “accurate” information our intellect supplies. Even the term “emotional” has come to mean weak, out of control, and even childish. "Don't be a baby!" we say to the little boy who is crying on the playground. "Leave him alone! Let him work it out!" we admonish the little girl who runs to help the little boy.

On the other hand, our abilities to memorize and problem-solve, to spell words and do mathematical calculations, are easily measured on written tests and slapped as grades on report cards. Ultimately, these intellectual abilities dictate which college will accept us and which career paths we‘re advised to follow.

However, intellectual intelligence (IQ) is usually less important in determining how successful we are than emotional intelligence (EQ). We all know people who are academically brilliant and yet are socially inept and unsuccessful. What they are missing is emotional intelligence.
What is emotional intelligence?

Emotional intelligence is the ability to identify, use, understand, and manage your emotions in positive and constructive ways. It's about recognizing your own emotional state and the emotional states of others. Emotional intelligence is also about engaging with others in ways that draw people to you.

Self-awareness — The ability to recognize your own emotions and how they affect your thoughts and behavior; know your strengths and weaknesses; and have self-confidence.

Self-management — The ability to control impulsive feelings and behaviors; manage your emotions in healthy ways; take initiative; follow through on commitments; and adapt to changing circumstances.

Social awareness — The ability to understand the emotions, needs, and concerns of other people; pick up on emotional cues; feel comfortable socially; and recognize the power dynamics in a group or organization.

Relationship management — The ability to develop and maintain good relationships; communicate clearly; inspire and influence others; work well in a team; and manage conflict.

Her father died when she was 9, and her mother worked two jobs to support her and her brother to good schools. She was brought up in a rough neighbourhood but she managed to join the finest universities in the land, Princeton and Yale, and the rest is history; an all-American girl achieving an American dream.
To add drama to her life story, we are told that she found it hard at first to adjust to campus life, which was eons away from the harsh realities of the Bronx.
It is a warm story that will melt hearts. There are many such stories around us, including the one about a black boy who becomes the most powerful man on earth. We need those stories not just to motivate us but, also to remind us that these people faced insurmountable odds to get to where they are. For many of them, success did not come easy. Success comes with tears, determination and sheer hard work.
Remember, to all those successful people, there always the unsung heroes behind those who succeed. In Sonia’s case, it’s her mother.

Light in the face of problems

Of late, an increasing desire to deliver no matter what happens, coupled with the compulsion to fulfil targets, keep deadlines and meet demands is making the hard pressed urbanite walk on high tension wires!

Certain professions can aggravate a latent problem in a person.

When the outcome of one’s work is dependent on factors not directly under one’s control, there is frustration and stress. ( that’s my situation I’m facing right now)

The more the number of variables, the more the possibility of anxiety and stress- related disorders. There is no joy in life.

In professions where there are goals to follow and targets to attain, if one is unable to cope with the demands, one often succumbs to the pressure. .( that’s another situation I’m in )

Variables like more and more people joining at the same level and market competition, are not under one’s control.

Life is dependent and also interdependent. In groups, we learn to live and experience its various tenets and facets.

Knowing your abilities and needs is important. Being smart alone is not enough. There are many smart people around but there is no tolerance, patience or flexibility.

These are qualities that can take one far. Most important is that we should enjoy doing whatever we are doing now.

Do you realize that the only time in our lives when we like to get old is when we're kids? If you're less than 10 years old, you're so excited about aging that you think in fractions.

'How old are you?' 'I'm four and a half!' You're never thirty-six and a half. You're four and a half, going on five! That's the key

You get into your teens, now they can't hold you back. You jump to the next number, or even a few ahead.

'How old are you?' 'I'm gonna be 16!' You could be 13, but hey, you're gonna be 16! And then the greatest day of your life ! You become 21. Even the words sound like a ceremony. YOU BECOME 21. YESSSS!!!

But then you turn 30. Oooohh, what happened there? Makes you sound like bad milk! He TURNED; we had to throw him out. There's no fun now, you're Just a sour-dumpling. What's wrong? What's changed?

You BECOME 21, you TURN 30, then you're PUSHING 40. Whoa! Put on the brakes, it's all slipping away. Before you know it, you REACH 50 and your dreams are gone.

But wait!!! You MAKE it to 60. You didn't think you would!

So you BECOME 21, TURN 30, PUSH 40, REACH 50 and MAKE it to 60.

You've built up so much speed that you HIT 70! After that it's a day-by-day thing; you HIT Wednesday!

You get into your 80's and every day is a complete cycle; you HIT lunch; you TURN 4:30; you REACH bedtime. And it doesn't end there. Into the 90s, you start going backwards; 'I Was JUST 92.'

Then a strange thing happens. If you make it over 100, you become a little kid again. 'I'm 100 and a half!'

May you all make it to a healthy 100 and a half!!

HOW TO STAY YOUNG

1. Throw out nonessential numbers. This includes age, weight and height. Let the doctors worry about them. That is why you pay 'them.'

Overdue

Mr Borg comes home one night, and his wife throws her arms around his neck:
"I have great news: I'm a month overdue.

I think we're going to have a baby!

The doctor gave me a test today, but until we find out for sure, we can't tell nybody."

The next day, Mrs Borg receives a telephone call from Enemalta Corporation (Electric Company) because the electricity bill has not been paid

"Am I speaking to Mrs Borg?"

"Yes....... speaking"

Enemalta guy, "You're a month overdue, you know!"

"How do YOU know?" stammers the young woman.

"Well, ma'am, it's in our files!" says the Enemalta guy.

"What are you saying? It's in your files...... HOW????? "

"Yes ............. We have a system of finding out who's overdue"

ýÿGOD!!!!!......... This is too much.........."

Madam, I am sorry...... I am following orders..... I have to inform you are overdue"

"I know that ....... let me talk to my husband about this tonight.....he will speak to our company tomorrow"

That night, she tells her husband about the visit, and he, mad as a bull, rushes to Enemalta office in Marsa the next morning.

"What's going on? You have it on file that my wife is a month overdue? What business is that of yours?" the husband shouts.

"Just calm down," says the lady at the reception at Enemalta, "it's nothing serious. All you have to do is pay us."

"PAY you? and if I refuse?"

"Well, in that case, sir, we'd have no option but to cut yours off."

"And what would my wife do then?" the husband asks.

"I don't know. I guess she'd have to use a candle."

Malaysians still not reading enough, says Muhyiddin

KUALA LUMPUR: Although Malaysia has among the highest literacy rates in South-East Asia, Malaysians prefer light reading material like newspapers and magazines to books.

According to literacy statistics, out of 85% of Malaysians who read regularly, 77% of them prefer newspapers, 3% read magazines, 3% read books and 1.6% read comics.

“If we were to compare with American citizens, 53% of them read fiction and 43% of them read non-fiction books.

“Malaysians are more inclined to read light material while citizens from developed countries read books,” Deputy Prime Minister and Education Minister Tan Sri Muhyiddin Yassin said at the launch of the Kuala Lumpur International Book Fair 2009 at the Putra World Trade Centre yesterday.

The text of his speech was read out by Deputy Education Minister Datuk Dr Wee Ka Siong.

The UN Development Programme’s 2007/2008 report said the literacy rate of Malaysians, at 93.2%, was behind developed countries like Japan, Britain, the United States, Australia and Germany, which have literacy rates of 99%.

“We still have room for improvement in terms of increasing the literacy rate to 99% by 2020 and the quality of material that we read. Parents play an important role in nurturing the reading habit among their children.

“Students should read more books, not just revision books or textbooks for examinations,” he said.

The organiser of the book fair has targeted 2.5 million visitors this year. Last year, 2.2 million people visited the book fair compared with 700,000 in 2006.

Muyhiddin also said that more bookstores should be opened in the country. Currently, 45% of bookstores are in the Klang Valley, 20% in Penang and Perak, while Johor has 10%.

Book fair organiser Datuk Ivan Hoe said Malaysians thought twice about spending money on books but not on food.“They forget that books are intellectual food,” he said

Why has Sibu-Durin road taken so long to complete?

SIBU: DAP state chairman Richard Wong Ho Leng wants the gov’t to explain why the Sibu-Durin link road has taken so long to complete.

“ Works commenced three years ago, and today the road is still under construction,” he lamented.

He said the gov’t should explain why the delay and tell the public what is the actual progress of the works.

“ At the same time the gov’t should should instruct the contractor to expedite the works.”

I’m equally perplexed and concurred with Richard Ho that why no action is being taken by the gov’t as well as the consultants as to the delay? Is it another project undertaken by the rich and the powerful politicians?

Don’t the contractor has an obligation to take steps to demonstrate or give assurances that progress is being made toward a timely completion of the contract or to explain that the reasons fro any prospective delay in completion of the contract are not the responsibility of the contractor.

ALL-ENGLAND/ Birmingham 2009: Chong Wei faces fiery Lin Dan in final today

IT was the much anticipated clash the badminton fraternity was waiting for and true to form, World No 1 Lee Chong Wei and Olympic champion Lin Dan of China will do battle to own the All England men's singles crown in Birmingham today.

Chong Wei found his touch with a classy 21-8, 21-13 win over Indonesian rival Taufik Hidayat of Indonesia while Lin Dan received a favour from his compatriot Chen Jin who conceded a walkover due to injury in the semi-finals.

Lin Dan, despite being seeded second, will start as the favourite after having beaten Chong Wei rather easily in their previous two meetings - the Beijing Olympics and China Open finals last year - and will be going all out to repeat the feat.

Chong Wei, on the other hand, must be ready to challenge his mighty rival who is in fiery form this week.

National singles coach Misbun Sidek, in a telephone interview from Birmingham, said Lin Dan holds the advantage in the final.

"It's all in the mind for Chong Wei. Lin Dan is the favourite but I want to see a challenge from Chong Wei this time," said Misbun.

"It is going to be very good match as both Chong Wei and Lin Dan are the top two players in the world and are at their best at the moment.

"The final will be all about tactics and strategies and how well Chong Wei can counter Lin Dan as he did against Taufik (in the semis)."

Dealing With Criticism

Whenever you run into situations in which you are dealing with negative information, there are three appropriate responses. You may choose to use only one, but use three if the situation requires a more thorough response. In the end, there is no substitute for your best judgment. Normal responses- but exactly what not to do – is to get defensive, angry, depressed or seek revenge. To gracefully, tactfully and diplomatically turn the criticism around, you may try these responses.

ASK FOR DETAILS OR SPECIFICS

Ask the person to fully explain the nature of the criticism using open-ended questions such as who, what, when, where, why or how. You don’t want your questions to sound like an interrogation, but you also want to know the breadth and depth of the criticism so that you can address it completely and accurately. There is a tendency for criticisms to become exaggerated in the retelling so it’s important to understand the current version in the critic’s mind.

SELF-DISCLOSE

One afternoon a wealthy lawyer was riding in his limousine when he saw two men along the roadside eating grass.
Disturbed, he ordered his driver to stop and he got out to investigate. He asked one man 'Why are you eating grass?'

'We don't have any money for food,' the poor man replied. 'We have to eat grass.'
'Well, then, you can come with me to my house and I'll feed you', the lawyer said.

'But sir, I have a wife and two children with me. They are over there, under that tree'.
'Bring them along,' the lawyer replied. Turning to the other poor man he stated, 'You come with us also.'

The second man, in a pitiful voice then said, 'But sir, I also have a wife and SIX children with me!'

They all entered the car, which was no easy task, even for a car as large as the limousine was.

Ex- president Chen alleges political persecution

Taiwan's ex- president Chen Shui -bian insisted that corruption charges against him were political motivated as he returned to court in a case that has already seen his wife plead guity.

"I always respect the judicial system, but now i can't trust it anymore. Prosecutors have fallen so low as to become political tools....some intervened in political and partisan affairs." he told the judges.

He is accused of embezzlement, taking bribes, money laundering, influence peddling and extortion, and faces life imprisonment if convicted on all counts.

Chen is alleged to have pocketed 1.5 billion Taiwan dollars ( US44 million) while in office, including a bribe of US 9 million in a land deal.


Are we going to witness our politicians and cabinet ministers esp. past and present Law Minister, PM singing the same tune as Chen Sui-bian if convicted of the same crimes esp. with the setting out of MACC ? I'm only optimistic if ( ONLY IF ) MACC is not use as a political tool but the ruling gov't. At this point of time and the recent development, i doubt it would achieve the desire objective. Prove me wrong .........

More Jobs cut, more bad news..........

In London; British mining group Anglo American said it would cut 19,000 jobs this year after reporting a 29-per cent fall in 2008 net earnings to US5.2 billion ( 4.1 billion euros) because of the global downturn.

In US; It was reported nearly 5 million people were collecting unemployment benefits, a record high amid the recession.

In Brazil; Brazilian aircraft manufacturer Embraer slash more than 4,000 jobs, or 20 per cent of it’s workforce, because of the “ unprecedented crisis hitting the world economy.”

In New Delhi; India’s finance minister said that workers may have to accept pay cuts if necessary to protect their jobs .

In Beijing; Multinational companies are hiring less or cutting existing staff in China as they struggle through the global economic crisis.

1) Nissan

There seems to be no end to the job-cutting spree all across the world. Thousands of more jobs are set to go in the coming months.
In one of its biggest layoffs, Japan's third largest auto company Nissan is planning to lay off 20,000 employees. The job cuts would take place during the next 14 months.
The company also plans to cut salaries and scale down investment plans. Nissan is likely to see a net loss of $2.89 billion in the financial year ending March 31, 2009.
For the October-December third quarter, Nissan posted an operating loss of 99.2 billion yen and a net loss of 83.2 billion yen.

2) General Motors:

General Motors Corp has announced that the company may need $30 billion in total government grants to tide over the crisis. The company has submitted a plan on the company's long term viability to the government.
The company plans to cut 47,000 jobs worldwide and shut down five more US factories.
GM was granted a $13.4 billion loan in December.
GM has closed down 12 manufacturing facilities in the US between 2000 and 2008. GM will shut down 14 more facilities by 2012, five more than were included in the December 2008 plan.


3) Pioneer:

Japanese electronics company Pioneer plans to slash 10,000 jobs.
The company struggling under the recession also plans to shut down its loss-making flat-screen television business. The fall in global sales had led to an earlier elimination of 5,900 jobs last year. Pioneer currently has a global workforce of 36,900.


4) ArcelorMitta:

The world's largest steel producer is in trouble. It plans to lay off 9,000 employees across the globe. Of these, 6,000 jobs will be from Europe.
ArcelorMittal workers across Europe gathered in Brussels recently to protest against job losses.


5)Nike:

Nike plans to slash 1,400 jobs. It has a global workforce of 35,000.
The company will also slash its marketing budget to cut down expenses.

Speed Up Implementation of Projects

PM urges sector to buck up in planning projects under stimulus plan to generate economic growth


Only 70% of the RM7 billion economic stimulus package announced last November has been disbursed and Datuk Seri Abdullah Ahmad Badawi wants the public sector to buck up in planning and implementing people-oriented projects under the package to generate economic growth.

Pm said if the money is was not spent quickly, the gov’ts effort to stimulate growth to cushion the impact of the global economic crisis would not be realized.

“We understand that the allocation has been given, so it is the duty and responsibility of all of us to work as quickly as possible so that the project can be implemented’.


Pak Lah,

We, contractor are fully behind the stimulus package esp. during this economic crisis not only to generate growth but also to generate revenue for companies to survive esp the private sector.

But the implementation is just too bureaucratic and insidious. The culture of money politics are mushrooming esp.in this difficult time and a golden opportunity for those who are in the power to award projects.

Mr. PM, you may successfully implement the speedily of the public delivery system but projects implementation is a totally difference kettle of fish altogether.

Chap Goh Mei Dinner

Guese what? We are celebrating Chap Goh Mei with a BANG! After returning from site, we all take a quick shower and off for BBQ steamboat dinner @ 6:30pm. The place is called Twin Star BBQ Steamboat House. It’s full house! Believe it or not. Sibu populace just don’t enjoying their home cook meal even at this very last day of CNY. What more to say eating at home at any other working days? For us, we have no choice. Pity us!

Anyway, all of us are in the mood for cooking. I even surprise by how to carry out the task although with clumsy hands or fingers ( like me)! Meantime, I think I understand better now why men are made better cook than women! He…he…he….

During the course of the dinner, we witness fire works performance by those enjoying their money burnt and disappeared in the dark sky.

Oops, our Director Lim Sim Huang deserved a special mention here for his sponsor. This is an honour we can’t refuse; after all he is our boss. We are filled by a profound sense of reverence and respect for a man who is, at that moment, reminding me of what a humble man he is.

Another Beginning New Year 2009

This is a joke i came across in one of our local daily newspaper and it's a way to wishing all malaysians A Happy New Year and a rewarding yera ahead.
Ah Lian was a pillion rider holding 2 big bags of durians when their motorbike rode over a hump in the town of Balik Pulau i front of the bus terminal.
The rider, her husband, Ah Beng heard a loud `bang!'. He asked Ah Lian, `Durians wu kalau boh? ( `have you drop the durians?)'
Ah Lian shouted: ` Bog kalau! Boh Kalau!Boh Kalau!
So Ah Beng did not bother & continued with the journey along the long & winding road towards Paya Terubong.
When they reached home in Bayan Lepas, Ah Beng got down fron his bike, he was shocked to see Ah Lian without helmet.
He asked Ah Lian: ` Where ids your helmet?' Ah Lian was very angry & replied: Just now i already told you BOH KALAU!'

US President blasted Wall Street bonuses handed out

US President blasted Wall Street bonuses handed out amid the financial crisis.

Taking on one of the most politically explosive issues of the economic downturn, Obama expressed outrage over a report that Wall Street fiems gave out more than US$18 billion in bonuses last year.

" That is the height of irresponsibility. It is shamful," the president said, calling on US financial firms to "show some restraint and some discipline and sense of responsibility."

Well, readers, what's your take on this. My company gave us a token of appreciation for the CNY. Is this a sense of irresponsibility on the part of the management? I strongly disagree. In fact, i lauded their wise decision.

Very soon, i confidence this company would achieve the status of a behemoth organization.

Back To Work

Back To Work

On our way back to Sibu on 30/01/09, we were welcomed by continuous torrential rain since a few days before CNY. Hardly a day passed without heavy rain and landslides news hitting headlines; Heavy downpour takes toll on roads, Water level still high, Evacuation centre closed but on standby and more…..

The project site is in a deplorable condition and manpower is yet to reach the anticipated maximum requirements and would only be back to normal by 2/02/09, hopefully.

Lots of catching up to do; in terms of paper work and chasing site progress, especially. We hope to complete the project by this August or at least by December 2009. And move on to another project base in Kuching. Nearer to home and family.

While having a small talk with my MD, I was given the assurance that no retrenchment and the organization would function as usual. However, site management need to be beefed up to prevent chronic waste of resources during the present economic meltdown. My management support is highly commendable.

Let’s hope things would go well and complete the project ASAP.

Govt to pay RM1 bln VOP to contractors

The government is expected to pay around RM 1 billion as Variation of Price ( VOP) to contractors of over 1,000 9MP projects by 2010, said Works Minister Datuk Mohd Zin Mohamad.

` The Minstry of Works has identified 1,311 government projects which are eligible for the payment under VOP. The gov’t has paid out RM44.2 million to contractors of 270 gov’t projects as at Nov 17, 2008.’ he said.

He added that VOP is an effort undertaken by the gov’t to help contractors minimize losses caused by the drastic price increase of building material such as steel, particularly last year.

` On Aug 6 , 2008, the gov’t decided to implement a new method to calculate VOP in order to minimize the losses of contractors due to the increase in construction cost.’ said Zin.

He explained that under the new method, 11 types of building materials were considered under VOP for civil engineering projects compared to five in the past.

For projects under building construction, VOP is based on changes in the cost index for 14 materials and steel prices.

The gov’t has also agreed to implement VOP for mechanical and electrical ( M & E ) projects with the condition that they are under civil engineering or building construction.

` Meanwhile the gov’t also considering backdating the implementation date for the steel VOP to Jan 1, 2008 from May 12, 2008 previously. The gov’t will maintain its 50:50 risk sharing with the contractors,’ he said.

Besides steel, Zin said the VOP is also applied to copper and iron for M & E projects which were implemented from July 1, 2008.

The Missing Brick

Once, when I and my wife were traveling, I received a fax from my secretary.

`There’s one glass brick missing for the work on the kitchen renovation,’ she said. `I’m sending you the original plan as well as the plan the builder has come up with to compensate for it.’

On the other hand, there was the design my wife had made: harmonious lines of bricks with an opening for ventilation. On the other, there was the plan drawn up to resolve the problem of the missing brick: a real jigsaw puzzle in which the glass squares were arranged in a higgledy-piggledy fashion that defied aesthetics.

`Just buy another brick,’ wrote my wife. And so they did, and thus stuck to the original design.

That afternoon, I thought for a long time about what had happened, how often, for the lack of one brick, we completely distort the original plan our lives.

Flooding in Sarawak

Floods wreak havoc in Sarawak – Day 2

Today it’s a much better day although experiencing drizzling weather condition. We were able to travel to & from work in our FORD vehicle and onto a new top up layer of stone and gravel on existing roads as a temporary road base (or rather sub base) spread, leveled, & rolled & well consolidated for residents to go to school and work. I suppose it’s an initiative by local councils and JKR while begging for funds from the federal gov’t. Well, It’s a good election gimmick for some aspiring MPs and future WORKS Minister! Currently, we have a Deputy Minister of Housing in Sibu and would be timely to have a Foochow Works Minister!

Malaysian MPs seems to be singing the same old tune again and again every time a disaster struck. Landslide at Bukit Antarabangsa, Highlands Towers just to name a few. Developers are issued with STOP WORK order by relevant authorities BUT not for long. After a few months, bulldozers & excavators start to roll again. Short memories, Malaysian isn’t it?

Flooding in Sarawak is an old issue esp. in Sibu. Flood mitigation Plan would surface every time an election comes near. It’s again a forum for candidates to lies , lies…lies..an get elected. Can’t blame them. It is all part and parcel of the pathetic attempt to win votes at any cost. Of course, it will lead to that fateful days when the electorate says’ ` Now that you have won, where are the things you promised us?’ It’s axiomatic that they can’t deliver the Flood Mitigation Plan budget even after surveyed & research by so-called Chinese expert. Sign……….Nightmare scenario……..

Well, so much about politics. Yeh Politics! Flooding would be the main political issue in the coming election and give the opposition an advantage and claim political mileage.

It’s time for sarawakian Mps to get it’s act together and insist on the budget from the federal Gov’t to ease the suffering of the people. Ya, they do have the people at heart, don’t they?

In view of the present weather condition, we are skeptical about the road condition from Sibu to Kuching. We are heading home next week to celebrate CNY. Hope the condition would improve and safely home.

Flooding in Sarawak

Floods wreak havoc in Sarawak – Day 1

It’s landas season in Sarawak creating havoc and forced thousands of people to move to higher ground and evacuate not only those living in the low -lying areas of the interior part of Sarawak but also including town and cities throughout the state.

From newspaper report, the floods may get worse in next few days lasting till January 14. The place that I stay is no exception, worsen by incessant rain and poor drainage. Today, we were all stranded at home. Roads leading to the main road were cut off after heavy rains. Only heavy vehicles like buses and lorries could pass through. My site vehicle `Ford’ ( ah, American product!) can’t get through.

However, with the spirit of `YES WE CAN’, we braved the floods and rains to reach the nearest shophouse ( 300M from our house) & informed one of my supervisors to fetch us from there.

During the journey, I requested my QS to take a few pix of the flood situation while we were walking towards higher ground. I was at 2 feet knee deep water level which I thought why not take a photo of me braving the floods with my working bag / laptop and in shorts & t-shirt too! Sadly he took the photo of me when my both feet were submerged by 6 inches high water level. ( no wonder he is a QS- Calculative). My initial intention is to prove how determine all of us despite the situation and the risks where we could have just stay at home and continue sleeping and dreaming about the coming Chinese New Year.

According to Dr M, a credible & intelligent leader must be in the frontline to his his subordinate and not just give orders from behind the scene. In short, LEADERS MUST BE BRAVE ENOUGH TO TAKE RISKS'. So, am i a leader? Anyway, the water is too swallow to get drown!

Well, being dedicated and loyal employees and sense of responsibility to complete the project, an unnecessary day off it’sinful and not our cup of tea.

At last, we reached the office at 10;30 am. Rains continue and the whole site messy. However, rains stopped after lunch and we managed to place 50m3 of concrete to one of the quarters’ slab.

It’s 6pm and we leave our site office taking a ride from our Resident Engineer’s car. He is a good man indeed. As the water keeps rising, he dropped us by the roadside while flood waters spilled onto the stretch of road nearby and we `paddle’ home the same route. Feeling tired, I took a nap and by 8pm I browsed through some paper work and prepare for tomorrow’s `nightmare’.

Hopefully it’s getting better and under control, at least to the route taking us to work.

Can we blame Mother Nature or rather can we fight Mother Nature?, according to Kuching Barrage Management S/B GM, Captain Goh Chin Guan. sound nope!

Courage & honesty bring sucess

SUCCESS means to reach such a constant level of positive thoughts that good actions happen naturally. Good actions are like good seeds which, when planted, produce healthy sweet fruit. As you sow, so shall you reap.

Concern for the quality of our actions today ensures the success of our tomorrow.Virtues are the mainstay in this b'cos success like this requires hope, & hope, in today's world requires courage.

It is a matter of working from the strength of our convictions which is a spiritual kind of honesty. Balance of both hope & courage makes our path easier.

We will only then move forward & our success will also be assured. Courage alone does not bring success. If there is only courage, there will be ego.

Notice how many times you put yourself down during the day. Include what you think & say, & words spoken in jest.

Pay particular attention to how you react to your mistakes & poor choices. Think of yourself as a child who is learning to walk; you need encouragement - not criticism.

Thought for reflection:

The hopeful man sees success where others see failure; sunshine where others see shadows and storms.

My thought;

Every successful person has a painful story.

Accept the pain & get ready for success.

Stop blaming mother nature

WHEN a crisis occurs, people tend to blame everyone else but themselves. If someone meets with an accident due to his own inadequacies, they say that it is an act of GOD.

Is God there only to punish us? God bestows happiness and removes sorrow. Instead of pointing fingers here and there, it is far better to focus on what we can do.

Sometimes, we think values are only connected to morals and ethics. But just look at the condition of the world around us and we can see that we are living a life almost devoid of values.

We have said: " We can control the environment, we can dominate it but we do not have to respect it."

Can we say that today? We have come to a point of crisis. I think we have been shocked by the results of what we have done.

It is our past actions that have led to the pollution of the environment; increased noise and heat levels, the decimation of the forests and landslides today.

So now we say:" Ah, but there should be respect; respect for life, for the environment; for all forms of life and definitely, there should be respect for human life."

Living a life of moderation is the best way out.

Many charters may be signed and environmental laws passed, but we will continue to damage the environment and destroy our home until we learn to respect life.

I can only respect life"out there" when i respect myself "in here".

Thought for reflection: Let us take responsibility for our own actions.

Happy New Year 2009

Happy New Year, Let's start with a joke,

Ah Lian was a pillion rider holding 2 big bag of durians when their motorbike rode over a hump in the town of Balik Pulau in front of the burs terminal.

The rider, her husband, Ah Beng heard a loud `bang!'. He asked Ah Lian, `Durians wu kalau boh? ( Have u drop the durians?)

Ah Lian shouted` Boh Kalau! `Boh kalau'! So Ah Beng did not bother & continued with the journey along the long & winding road towards Paya Terubong.

When they reached home in Bayan Lepas, Ah Beng got down from his motorbike, he was shocked to see that Ah Lian was not wearing helmet.

He asked Ah Lian: `Where is your helmet?' Ah Lian was very angry & replied:` Just now i already told you BOH KALAU!'
